Drag Racing Attorney in Surprise Arizona
As a criminal defense attorney, we help those that have been charged with Drag Racing in Surprise AZ. ARS 28-708 makes it illegal to drag race, or to participate in any other sort of vehicle race involving excessive speeds. However, the law does not apply to a person participating in a properly organized event.
Penalties for Drag Racing
In the state of Arizona, racing on public roads or highways is deemed a class 1 misdemeanor. This is the most serious of misdemeanors and can incur a custodial sentence of up to 6 months, as well as a fine of up to $2,500. In cases of racing on highways, for a first offense, fines are typically set at $250 unless there are mitigating circumstances.
If you re-offend within a 24 month period, your charge will be elevated to a class 6 felony, requiring you to spend 1 year in jail, with parole and probation denied within this period. Offenders charged a second time will also be required to face a fine of a minimum of $500.
In special circumstances, if you are currently engaged in employment or education, you may be permitted to attend your work or school during open hours, and spend the remaining days, or parts of days serving your custodial sentence.
